I have failed the occupational health report due to absence over last 2yrs, and will now not be starting in september

Oh my god - how much absence did you have and what were your reasons for being off - I am so sorry for you - have they offered you a deferred place or just said no???

Do you mind me asking what your absences were for? I only ask because I did a lot of work on a Disability Forum and know quite a bit about employment law related to it. I used this to explain my absences because I suffer from depression, and I am perfectly within my rates to say that it is a disability...

"The Disability Discrimination Act (DDA) defines a disabled person as someone who has a physical or mental impairment that has a substantial and long-term adverse effect on his or her ability to carry out normal day-to-day activities."

In my case I was completely unable to work when I was ill, and would miss a few days in a row. I still was only ill about the 'average' of 12 days a year though. Just in case it is relevant for you (*crossing my fingers*) here is a useful link:

This is quite worrying for a few people I can imagine - myself included I have had a lot of time off this year due to depression (probably about 3 months) - going through divorce, marriage ending etc and I am applying for 2009 entry, I hope that this doesnt stop me getting in.

from jan 06 to jan 07 i had 8 occasions, 1 of which was for 106days and that was stress and depression, another for 15days for same reason, the rest were 2 or 3 days for reasons such as D&V, and children D&V (not excusing it but i am a single mum with no actual support network) and it also ncluded 1day for a funeral

That's awful! I can't believe they've turned you down for that. Don't let it go; definitely have a look at Bunny's info and see if you can appeal the decision.
